Section 106 Consultations
Section 106 of the National Historic Preservation Act requires the Federal Energy Regulatory Commission to take into account the effect of licensing a hydropower project on any historic properties, and allow the Advisory Council on Historic Preservation (ACHP) a reasonable opportunity to comment on the proposed action.

- Assisting with permission for the applicant to initiate section 106 consultation on behalf of FERC and conduct the day-to-day section 106 consultation responsibilities in regards to the licensing effort
- Assisting with consultations between the client, FERC, the State Historic Preservation Officer (SHPO), any interested Indian tribes, and other consulting parties pursuant to 36 C.F.R. § 800.2(c)(5) of the regulations implementing section 106 of the National Historic Preservation Act
- Supervising applicant’s archaeological, historical, and traditional cultural resource surveys, reviewing survey results, and preparation of reports for inclusion in any license application
- Assisting with the development of a programmatic agreement (PA) or memorandum of agreement (MOA) and a historic properties management plan (HPMP) to address all identified adverse effects on the historic properties for the term of a new license
- Inclusion of the HPMP in the applicant’s license application
